NIGHTCLUB CONTROVERSY
Petitiners push for court verdict

August 27, 1978—Night spot operators in Dumaguete City have pressed
for a court verdict as to whether the “Night Club Ordinance” in the city
is Constitutional or not, even as it politely led the proposal of the
Sangguniang Panlalawigan to mend objectionable portions of said law.
Atty. Saleto Erames, counsel for petitioners
representing no less than 14 night club
operators in Dumaguete, stated five major
reasons why it is contemptuous for the
Sanggunian to precede with sending the controversial
Ordinance No. 46 in the face of a
pending civil case in Court: 1. The law’s validity
or invalidity is placed before a social
forum and is already beyond the reach of legislative
authority; 2. Only the Court can determine
the rights which are intertwined
in the Constitutional issues at hand; 3.
The Sanggunian can no longer interpret
Ordinance 46 since it is now taken
over by the Court; 4. To deprive the
judiciary to render a decision through
legislative maneuvers will undermine the
independence of the judiciary; 5. That
any new move to date should be taken
in the light of he case in Court.
TWENTY YEARS AGO
Province ban mini-lotteries
August 21, 1988— The provincial government on an unprecedented move
“despite all odds” voted unanimously through the provincial board the
first provincial ordinance aimed at banning the operation of mini-lotteries
all over Negros Oriental.
Dubbed as Provincial Ordinance No.
1 signed by Gov. Emilio Macias II, the legal
basis of the measure is Batas Pambansa
Blg. 42 otherwise known as the “Act
amending the charter of the Philippine Charity
Sweepstakes Office.” Authored by
Kagawad Toti Villarin, the ordinance cites
Sec. 1, paragraphs A and B which states
that while the PCSO can conduct lotteries,
it cannot undertake such activity in joint
venture “with any person, association, company
or entity whether domestic or foreign.”
It may however undertake projects in
joint ventures with other entities except on
“sweepstakes races, lotteries and other similar
activities.”
TEN YEARS AGO
Council reciprocates
mayor statesmanship
August 22, 1998— The City Council reciprocated the humility and statesmanship
displayed by the City Mayor by approving his agreement to
embark on a City Master Plan for the next six years and appropriated
P50,000 as a “gesture of appreciation” by the city government and as
reimbursement of the team’s actual and initial expenses in coming up
with the Master Plan up to the year 2004. the team has offered their
services free of charge and professional fee, except their actual expenses.
From oppositor to supporter of the
plan, Kagawad Rommel Erames amended
his posture by delivering a privilege speech
warning all and sundry that the
Sangguniang Panlungsod henceforth
should not be “belittled of its honor, prestige
and performance” because like everybody
else in government, they are here
for public service and public interest. The
minor conflict between the mayor and the
Sanggunian ensued when Remollo sought
for such reimbursement and the Council thru
Erames objected stating that it cannot appropriate
an amount whose purpose the
council never approved. He accused the
mayor of by-passing the council. The mayor
assured the Kagawads that the council will
be consulted on an appropriate time when
the Master Plan is ready for its scrutiny.
