Claiming to be a childless couple, Filipinos, of legal age, residents of Hibbard
Avenue, Piapi, Dumaguete City, and have all the qualifications and none of the
disqualifications to adopt a child, petitioners, desire to adopt as their own child
KIARA KATE CATALO, a two months old minor and said to be qualified for adoption
and, as a consequence thereof, change the name of the child to KIARA KATE
CADIENTE RAMIREZ.
The petition which appears to be with the written conformity of the natural
mother of the said child, is set for hearing on September 8, 2008, at 9:00 o’clock in
the morning at the Session Hall of this Court at the Hall of Justice, EJ Blanco Road,
Dumaguete City. On which date, time and place, anybody may appear and show
cause why the petition should not be granted.
Furnish copies hereof to the petitioners, the Solicitor General, the biological
mother of the minor, and the City Civil Registrar of Dumaguete City, at their given
addresses.

PLAINTIFFS, by and through the undersigned counsel, before this Honorable Court most respectfully

2. Felipe Calingacion was the owner, and his capital properties, of several parcels of land known
as Lots Nos. 3277, 688, 661, 3342, 1037, 668, 502, 3276,and 493 all situated in Sibulan, Negros Oriental,
and which parcels are more particularly described and bounded as follows:

“A parcel of land (Lot No. 3277 of the Cadastral Survey of Sibulan, Cad. Case No. 15, L.R.C. Cad.
Rec. No. 358), with the building and improvements thereon, situated in the Barrio of Looc, Municipality

Paterno. Containing an area of Seventeen Thousand Forty Nine (17,049) Square Meters, more or
less. Declared for taxation purposes under Tax Declaration No. 99-17-001-1010 with an assessed
value of P31,480.00.”
3. Upon the death of Felipe Calingacion he was survived by his legitimate children, Julio,
Estanislao, Valentin and Lucia, all surnamed Calingacion, who, pursuant to the law on intestate
succession, inherited that above-described real properties.
4. Julio Calingacion got married to Alfonsa Basubas and they were childless.
5. After the death of Julio Calingacion his surviving spouse, Alfonsa Basubas, got married
again to Pedro Regalado.
6. Estanislao Calingacion died without any issue, while Valentin and Lucia Calingacion were
survived by the herein plaintiffs.
7. Defendants are the surviving heirs of the late Alfonsa Basubas and Pedro Regalado.
8. While Alfonsa Basubas was already married to Pedro Regalado she filed cadastral answers
for the aforementioned lots without the knowledge and consent of the surviving children of Felipe
Calingacion by alleging among others, that she is one of the surviving heirs of the late Felipe
Calingacion, when in and in fact she was not. Copies of the Cadastral Answers are hereto attached
as Annexes “A”, “B”, “C”, “D”, “E”, “F” and “G”.
9. Titles were issued pursuant to the above-mentioned Cadastral Answers in favor of Alfonsa
Basubas, Valentin Calingacion, Estanislao Calingacion and Lucia Calingacion over Lots Nos. 3277,
688, 661, 3342, 1037, 668, 502, 3276 and 493.
10. The act of Alfonsa Basubas in filing the cadastral answers for the subject lots and in
including herself as one of the surviving heirs of the late Felipe Calingacion and the consequent
inclusion of her name in the titles as one of the registered owners is unwarranted. She is, therefore,
deemed to hold in trust for the plaintiffs the portions of the above-described properties.
11. Defendants are in possession of the ¼ shares over the above-described parcels of lands
and they have been enjoying the income thereof for quite sometime already.
12. Following the principle of reserva troncal, the above-described parcels rightfully belong
to plaintiffs. Defendants are merely holding said properties in trust for the plaintiffs.
13. Plaintiffs demanded from defendants to reconvey to them the ¼ shares over the abovestated
properties but notwithstanding repeated demands, defendants have failed and refused to
reconvey the ¼ shares in question.
14. As a consequence of the unjustifiable refusal of defendants to reconvey the said 1/4
shares over the above-described parcels of lands, plaintiffs suffered tremendous worries, several
sleepless nights, anxiety, wounded feelings and other similar injuries which defendants should be
held liable to pay plaintiffs the sum of not less than P200,000.00 as moral damages.
15. In order to deter others from doing a similar act or the public good, defendants should be
held liable to pay the sum of P50,000.00 as exemplary damages.
16. Plaintiff was constrained to engage the service of the undersigned counsel in order to
initiate this suit to recover the ¼ shares from defendants, and they have agreed to pay the sum of
P50,000.00 as attorney’s fees plus P2,000.00 appearance fee for every appearance of counsel in this
case.
17. Plaintiffs have incurred initial litigation expenses in the sum of P20,000.00.
P R A Y E R
WHEREFORE, it is most respectfully prayed that judgment be rendered in favor of plaintiffs
and against defendants:
1. Ordering defendants to reconvey to plaintiffs the 0ne-fourth (1/4) shares of the abovedescribed
parcels of lands.
2. Directing defendants to pay, jointly and severally, to plaintiffs the following sums:
2.1 – P200,000.00 – as moral damages;
2.2 - P 50,000.00 – as exemplary damages;
2.3 - P 50,000.00 – as attorney’s fees plus P2,000.00
appearance fee for every appearance
of counsel in this case.
2.4 - P 20,000.00 – as initial litigation expenses.
Plaintiffs further pray for such other reliefs and remedies as are consistent with law, justice
and equity.

2008 at 8:30 in the morning at Session Hall of this Court, Regional Trial Court, Branch 45,
Bais City, inviting any interested person to appear on said hearing and to show cause why
the petition shall not be granted.
Let this Order be published in a newspaper of general circulation in the Province of
Negros Oriental and the Cities of Bayawan, Dumaguete, Tanjay, Bais, Guihulngan and Canlaon
once a week for at least three (3) consecutive weeks before the date of hearing. Furnish
copy of this Order to the Local Civil Registrar of Bindoy, Negros Oriental and to the Office of
